SALW Legislation in Montenegro

The Stabilization and Association Agreement (SAA) between Montenegro and the European Union was signed on 15 October 2007. Montenegro has made commitments under the SAA to approximate their legislation to that of the EU and especially to ensure its proper implementation. One of the areas for approximation is the control over acquisition and possession of weapons regulated by Council Directive 91/477/EEC amended by Directive 2008/51/EC. Although certain provisions of the current Montenegrin Law on Weapons include requirements that are stricter and exceed the minimum standard set by the EU legislation, the Law on Weapons does not conform among others to the systematisation and categorisation of firearms specified in the Directives.

SEESAC has presented to the Ministry of Interior of Montenegro a comparative legal analysis of the Montenegrin and EU legal frameworks on weapons control that would assist the authorities to achieve the required compatibility. This would improve legal security and avoid arbitrary interpretation of regulations and ambiguity in their application. The English version of the report can be downloaded here; the Montenegrin version can be downloaded here.
